Full Bench Explains Difference Between Employees and Contractors

The full bench of the AIRC has outlined the principles to be applied in determining whether a worker is an employee or an independent contractor

The case was an unfair dismissal one, Abdalla v Viewdaze Pty Ltd t/as Malta Travel [2003] FB of the AIRC (Lawler VP, Hamilton DP, Bacon C), PR927971, 14/5/03

The full bench followed the High Court in Hollis v Vabu and said that the law determining whether the worker is an employee or an independent contractor turns on a number of considerations and the AIRC listed the indicia that should be used in determining whether a worker is an employee or a contractor.
